There is a petition before US District Judge in Miami by a Jon Corbett, which asks that that the court block the TSA from using enhanced security procedures before the upcoming holiday travel season. The judge ruling will be Marcia G. Cooke, a Bush I appointee, who - although controversially - presided over the trial of José Padilla in 2007. She is described as a staunch civil libertarian.

The case number 1:10-cv-24106-MGC was filed by Corbett on November 16.

According to two sources within the court there will be a ruling either Monday or Tuesday issuing an injunction against the TSA from using the controversial procedures.

Stay tuned.

Fareed Zakaria, “We Over Reacted to 9/11″

Fareed Zakaria, the terrorist loving journalist that he is, claims we over reacted to 9/11.

“Nine years after 9/11, can anyone doubt that Al Qaeda is simply not that deadly a threat? Since that gruesome day in 2001, once governments everywhere began serious countermeasures, Osama bin Laden’s terror network has been unable to launch a single major attack on high-value targets in the United States and Europe. While it has inspired a few much smaller attacks by local jihadis, it has been unable to execute a single one itself. Today, Al Qaeda’s best hope is to find a troubled young man who has been radicalized over the Internet, and teach him to stuff his underwear with explosives.

I do not minimize Al Qaeda’s intentions, which are barbaric. I question its capabilities. In every recent conflict, the United States has been right about the evil intentions of its adversaries but massively exaggerated their strength. In the 1980s, we thought the Soviet Union was expanding its power and influence when it was on the verge of economic and political bankruptcy. In the 1990s, we were certain that Saddam Hussein had a nuclear arsenal. In fact, his factories could barely make soap.”

Yada, yada, yada. Same old crap we’ve been hearing from the anti Bush crowd for years. I think that Newsweek would be suffering enough readership problems without letting El Zakaria a moment at the keybord. That he cites notable leakers and freakers Dana Priest and William Arkin and that Larry Johnson gives him a high five tells you all you need to know. Perhaps that’s the point to get links and readers by pissing them off.

Of course is simply no defense of this drivel, but it’s typical for Zakaria. Using a lame argument that the lack of acts means no activity. There were plenty of gaps throughout the 90s that led to 9/11, but I digress into facts.

Quite frankly our reaction to 9/11 was stellar by that Zakaria’s reasoning. Nine years without an attack? Had we taken the Zakaria approach we may have seen an attack every 3-4 years perhaps earlier. But then it would have been no big thing as these would have been “Troubled young men who have been radicalized over the Internet” with bulging underwear.

What pisses the Zakaria’s of the world off is just how successful our “over reaction” was.

It’s little wonder this doof’s CNN show is near to being wacked by CNN because it’s ratings suck. Except of course in the middle east where I’m sure Bin Laden has it pipped into his cave to enjoy while reading his Newsweak.

Terrorist Sympathizer Fareed Zakaria Returns ADL Prize

Why they ever gave it to him in the first place is the question for the ages. Now in a snit, and an obvious attempt to shore up his next to nothing ratings on his CNN show, Fareed Zakaria has given back his ADL Hubert H. Humphrey First Amendment Freedoms Prize he got in 2005. The ADL response here.

“I hope you have read our statement on the proposed Islamic Center at Ground Zero and, more importantly, understand our position. We did not oppose the right for an Islamic Center or a mosque to be built. What we did was to make an appeal based solely on the issues of location and sensitivity. If the stated goal was to advance reconciliation and understanding, we believe taking into consideration the feelings of many victims and their families, of first responders and many New Yorkers, who are not bigots but still feel the pain of 9/11, would go a long way to achieving that reconciliation.”

Zakaria’s so-called “moderate Islam” position is a joke, one which which was called by this blogger in 2009 which he pressured Yale to drop the publishing of Mohammed cartoons citing “violence” and “sensitivity”.

Here he is telling a audience that they should “get over their fear of terrorism”.

McCain is right, there is no immediate right to Miranda

Lefties are wrong on this one and McCain is right. There is no immediate right to Miranda a suspect - period. Especially when there is a threat to the public safety. As a law enforcement type for 12 years I know what I’m talking about.

McCain said during the Imus show this morning when asked whether Shahzad should have been immediately mirandized.

“Obviously that would be a serious mistake…at least until we find out as much information we have,” McCain said during an appearance on “Imus in the Morning” when asked whether the suspect, 30-year-old Faisal Shahzad, a naturalized American citizen from Pakistan.

“Don’t give this guy his Miranda rights until we find out what it’s all about,” McCain added during an appearance on the Imus show, which is broadcast by the Fox Business Network.”

When you make a first approach to a suspect you CAN ask questions without miranda. In fact a 2004 Supreme Court ruling upheld state “stop-and-identify” laws, allowing police in those jurisdictions to require biographical information such as name, date of birth, and address, without arresting suspects or providing them Miranda warnings (Wiki).

Miranda warnings do not need to be administered when there is an imminent threat to public safety. This means that if a law enforcement official believes that “time is of the essence” in preventing death and mayhem there is NO right to miranda.

Class dismissed.

Opps, Media and the Left Jump the Gun on Adam Gadahn Arrest

Via CBS:

“An “important Taliban militant” was arrested today in Pakistan. But that is where the confusion started.

Earlier it was reported by Pakistani media that intelligence agents had arrested Adam Gadahn, the American-born spokesman for al Qaeda, in an operation in the southern city of Karachi.

It was further reported by the Associated Press and Reuters that Gadahn had been arrested, sourcing security officials.

CBS News was told by sources in the Pakistan government that it was Gadahn, even after U.S. officials refused to confirm it was the California native for whom a $1 million reward has been posted.

Now, CBS News’ Farhan Bokhari in Islamabad writes that earlier reports the detained individual was Gadahn proved false. According to a Pakistan security official who spoke with CBS News on condition of anonymity, the arrested individual is in fact “a Taliban militant leader who is known as Abu Yahya.”

The official said evidence compiled from an interrogation of the suspect and information exchanged with U.S. officials verified the man’s identify.

The reassessment only added to the confusion surrounding the arrest of a man earlier described by other unnamed Pakistani security officials as Gadahn.

“In the light of our latest information, I can say, this is not looking like Gadahn. But it is still the arrest of an important Taliban militant,” said the Pakistani security official who spoke to CBS News late Sunday.

The New York Times, sourcing American and Pakistani officials, reports that the man arrested was Abu Yahya Mujahdeen Al-Adam, and describes him as an al Qaeda commander who was born in Pennsylvania. “

Opps. And just when the left was jumping up and down screaming how this proves talking with your enemies produces results. Truth is that the Obama administration had nothing to do with this, nor any particular American intelligence units. It was totally a Pakistani effort, and indeed the arrest of caught the Obama administration off guard.

“We are checking with Pakistani authorities to confirm one way or the other,” said FBI spokesman William Carter.”
