There is little doubt that despite Obama calling the valid criticism of Sotomayor “nonsense”, that her nomination may not come at all. Now the White House appears to be backing away from her a bit.

“The White House said Friday that Judge Sonia Sotomayor, President Obama’s nominee for the Supreme Court vacancy, used a poor choice of words in a speech eight years ago when she suggested that a Latina judge would reach a better conclusion than a white male judge who doesn’t have the same life experiences.

“I think she’d say that her word choice in 2001 was poor, that she was simply making the point that personal experience are relevant for the process of the judging,” said Robert Gibbs, the White House press secretary.

Mr. Gibbs, speaking to reporters at the daily press briefing on Friday, did not expand on how he knew that Judge Sotomayor believes she misspoke. He said, “I have not talked specifically with her about this.”

There is also little doubt that the Obama administration knew of this blatantly sexist and racist remark when they vetted her. Which shows that their vetting process for selecting nominees continues to suck.

Indeed it appears that the only reason they pick her was that she is female and hispanic, most evidently believing this would make her “bullet proof”.

That’s why the only reason statement of “backoff” or scare tactic against the right is “If they oppose her they’ll piss off hispanics and won’t get their votes”. Of course which isn’t true otherwise Democrats would have suffered a backlash after their treatment of several hispanic nominees under the Bush administration.

Nope, Sotomayor is in trouble and they know it. Much as they try they can’t erase that she said what she said. Moreover what she said exposes what liberals believe and what they truly feel, and they’ve been hiding that from the American people for a long time. They are “embarrased” and that’s the last thing they need going into 2010 and 2012.

So the only question now is, when comes the withdraw for “family reasons”?
