The DNC needs a new set of legal hounds because they just broke the law. Namely the Laymen Act of 1999:
“The Lanham Act defines the statutory and common law boundaries to trademarks and service marks. Trademarks (and service marks) are words or designs used in the advertising of goods and services. Rights to use a trademark are defined by the class(es) for which the trademark is used. Therefore, it is possible for different parties to use the same trademark in different classes. The Lanham Act defines the scope of a trademark, the process by which a federal registration can be obtained from the Patent and Trademark Office for a trademark, and penalties for trademark infringement. The Legal Information Institute provides Title 15 of the US Code, which encompasses the Lanham Act.
So how? By registering the Trademarked name owned by ABC of “The Path to 9/11″, so that if you type direct your browser to pathto911.com, you end up at Democrats.org and a web form to complain to ABC about the movie. The absence of the “the”, I don’t think will buy them a pass.

Redstate says that ABC is beginning to pull their web ads for this movie. Stick a fork in this thing. The fix is in!

2Seems like an idiotic thing to do, especially considering that most people who do this are probably interested in the film and they are sent directly to the DNC. People hate being hijacked. Normally it’s for a scam and that is how people are going to feel in this case too!

6Mac, I think this may be too clever by half – while I’m sure the title of the show (and the rest of it) is copyrighted, I doubt they have actually gotten a trademark that would make this subject to the Lanham Act. A PTO online trademark search does not show any live or dead registration for “Path to 9/11″ – these searches are not up to the minute, but it reinforces the suspicion there is no trademark registration here. This isn’t my area of practice, but I’ll bet you know someone with the sort of access to the PTO systems that can give you current information.

I am absolutely appalled at the recent letter sent to ABC entertainment division from some members of Congress concerning their airing of a docudrama on the run-up to 9/11. It’s intent is chillingly and directly in violation of the above FIRST AMENDMENT TO THE CONSTITUTION!!!
For ANYONE in Congress to threaten either directly or indirectly, the freedoms we all enjoy regardless of our political affiliation, is stunning!!! I strongly urge the Speaker to look into this matter and STOP THIS AT ALL COSTS AND BY ALL MEANS AVAILABLE TO HIS OFFICE! First of all, I call for the IMMEDIATE CENSURE of all those involved in this threat and in cases where warranted immediate removal or resignation from office!!!
I NEVER thought that this sort of thing could ever happen in this country. I was wrong. I BEG OF YOU SIR, BY ALL THAT IS DECENT AND HONORABLE…DO NOT LET THIS STAND!!!

Mine is a letter to Attorney General Alberto Gonzales, with copies to the Pres, Frist (Senate Majority), Reid (Minority), Durbin (my so-called and a signer of the letter), and Henry Hyde (my Rep):
“Dear General Gonzales:
The purpose of my letter is to lodge a complaint, request legal inquiry and, if warranted, prosecutorial action against several elected officials. They have, under color of government authority, issued a coercive edict conveying implicit threat of retribution to executives and employees of a U.S. corporation engaged in lawful enterprises.
The victims of this extortion are citizens who were exercising their First Amendment right to freely express their own perception and interpretation of historical events, based on public records, testimony and personal recollections of individuals involved in those events.
The extortionists are United States Senators … ” (etc., etc., etc.)
I haven’t finished it yet, but in a call to Henry Hyde’s office (Durbin and Obama are non-starters for me), it became clear that House members really can’t do anything about the Senate. Frist is too “go along” to do anything (leadership is simply not his strength), and it is really a legal rather than legislative violation.
If anyone’s interested in doing this as a petition, let me know.
