“PHOENIX — The U.S. Justice Department has filed a lawsuit challenging the constitutionality of Arizona’s tough new law targeting illegal immigrants.
The government filed the lawsuit in U.S. District Court in Phoenix on Tuesday.
The lawsuit argues that Arizona’s new measure requiring state and local police to question and possibly arrest illegal immigrants during the enforcement of other laws usurps federal authority.
The government will likely seek an injunction to delay the July 29 implementation of the law until the case is resolved.”
This is likely to fail even before it gets to the Supremes. The premise is ridiculous as Arizona is not acting as the United States but acting within the confines of existing immigration law. If a court were to rule in the Government’s favor then states would lose all authority to act on behalf of the federal government.
It’s not going to happen. One these judges will get the case, I’m running the backgrounds and the numbers on them now. But at this point an injunction on the merits seems unlikely, but then that old ‘political’ justice may rule the day. We’ll see.
