Judge Susan Bolton, activist and Clinton appointee placed an injunction on parts of the new Arizona Immigration law, thus wrongly hampering Arizona’s right to protect their borders.

“PHOENIX — A federal judge, ruling on a clash between the federal government and a state over immigration policy, has blocked the most controversial parts of Arizona’s immigration enforcement law from going into effect.

In a ruling on a law that has rocked politics coast to coast and thrown a spotlight on the border state’s fierce debate over immigration, United States District Court Judge Susan Bolton in Phoenix said some aspects of the law can go into effect as scheduled on Thursday.

But Judge Bolton took aim at the parts of the law that have generated the most controversy, blocking sections that called for officers to check a person’s immigration status while enforcing other laws and that required immigrants to carry their papers at all times. Judge Bolton put those sections on hold while she continues to hear the larger issues in the challenges to the law.

“Preserving the status quo through a preliminary injunction is less harmful than allowing state laws that are likely preempted by federal law to be enforced,” she said.

“There is a substantial likelihood that officers will wrongfully arrest legal resident aliens,” she wrote. “By enforcing this statute, Arizona would impose a ‘distinct, unusual and extraordinary’ burden on legal resident aliens that only the federal government has the authority to impose.”

That’s bullshit of course. Jan Brewer should declare a state of emergency and order the enforcement of the law anyway. While she is at it she should have Bolton arrested for obstruction.

If illegals and their allies want a war, then let’s have a war. Residents of Arizona should go on a rampage, this is outrageous.

UPDATE: Spoke to a border town law enforcement official. Nothing in the ruling prohibits them from asking for immigration status, only that it’s not required. They plan on asking when suspicious of status.

Additionally Bolton’s ruling is illegal. No matter what anyone says officers can still arrest immigrants for failing to carry immigration papers. 

 Title 8 of the U.S. Code. Section 1304e requires that “every alien, eighteen years of age and over, shall at all times carry with him and have in his personal possession any certificate of alien registration or alien registration receipt card issued to him.” Those who fail to comply will be guilty of a misdemeanor and will be fined $100 and can be imprisoned up to 30 days.

All local law enforcement officers throughout the US can enforce this law as they can any other federal law in the performance of their duties. Judge Bolten’s ruling should be vacated on this point immediately, it’s in error.
