You’ve got to wonder about Patrick Fitzgerald.
“Special Prosecutor Patrick Fitzgerald urged a federal judge Tuesday not to delay former White House aide I. Lewis “Scooter” Libby’s 2 1/2-year prison sentence in the CIA leak case.
Libby, the former chief of staff to Vice President Dick Cheney, has argued that he has a good chance of winning an appeal and should be allowed to remain free until that challenge has run its course.
U.S. District Judge Reggie B. Walton, who sentenced Libby to prison for lying to authorities and obstructing the investigation into the 2003 leak of CIA operative Valerie Plame’s identity, has said he sees no reason to grant Libby’s request. He did not set a date for Libby to report to prison, however, and scheduled a hearing on the issue for Thursday.
A delay in Libby’s sentence would give President Bush more time to consider pardon requests from Libby’s supporters, who say the loyal aide was caught up in a political investigation and does not deserve prison time.
Fitzgerald, in court documents filed Tuesday, said an appeals court is unlikely to overturn Libby’s conviction because the evidence against him was so overwhelming.”
Well quite frankly Mr. Fitzgerald, that’s not your call whether or not there is any basis for appeal, although there might be a basis for throwing the whole conviction out if it’s determined that your appointment was even legal.
Nevertheless, you have to ask, “What is Fitzgerald’s hurry?” Who is he covering for?
Tom McGuire has a copy of Fitzgerald’s filing and quite frankly it looks like it was written by some dolt over at the Huffington Post rather than a seasoned prosecutor.
I just can’t wait for the movie.

1Walton would probably think Fitzgerald’s filing was one of the best he’s read.
I think Walton will decide that Libby needs to start spending time in jail.

3Clarice, hard to say. But it’s simply amazing how many times we find the Senior Senator (and Wilson chum) from New York. After all who courted Wilson and then pushed the original referral?
I wonder if Fedora has ever taken a look at this? One thing is for sure, Fitzgerald is NOT apolitical on this, not one iota.

4Read thru the thread we have some rather good evidence that Comey appointed him outside the regs because in the NSA leak case the DoJ career officials would not permit subpoenas to the media, that at the time of the appointment they KNEW it was Armitage and were aiming to nab someone else and could do so only by bringing the media into the game.
I’d sure like to talk to Eckenrode who seems to have been leaking round the clock to Waas.

5In case I wasn’t clear:
1. He knew it was Armitage
2. He knew to prosecute anyone else he’d need to subpoena reporters
3. In the NSA leak case DoJ officials refused to okay such subpoenas
4. He had authority under the regs to appoint a special prosecutor but under the regs that prosecutor had to get DoJ permission for such subpoenas
5. So he appointed someone disqualfied by the regs to serve in that position and made the appointment outside the regs to bypass that hurdle.

I don’t know,it’s the only thing that seems to fit.
Look at everything from the viewpoint of Fitz playing a duel role. Not only as the prosecution but also as a defense council for something/someone else. In other words he’s using the criminal court to establish facts, I believe it’s called estope. In this case it appears he is attempting to have the government establish as fact that Plame was involved in a covert CIA operation.

I have always thought that this whole thing was never what it appeared…didn’t make sense. And how about Judith Miller that tipped off a muslim charity….what ever happened about that?

I think it’s just the opposit. I think Fitz is attempting to cover up crimes committed by the Clinton’s, namely the Clinton’s handed the Iranians plans for a nuclear bomb.
Everything about this case appears as if they are attempting to create as fact, Plame was a covert operative, from a complete fantasy,no one knew she worked for the CIA.
I’m not an attorney, but common sense tells me if I was going to create a defense for a bunch of CIA operatives passing state secrets to the enemy, the first thing I would do was try and make it appear as if what they were doing was a covert CIA operation that was botched and now the Govt. wants to blame them for it.

15Isn’t it amazing how many times BJ Clinton and his cohorts used the phrases,”I can’t remember, I don’t recall, I don’t think I said that” and other such memory lapses? Yet the only thing Fitz could get anyone indicted for is “failing to remember” exactly what was said or when? Another obscene witch hunt by politicos searching for revenge or power, with no regard for what is best for America.
