The call is on for President Bush to end the farse which was the Plame Game and issue a presidential pardon to scooter libby. The editors at NRO who had previously called for the same reissue the call:

“Now, however, we have a new reason to call on President Bush to pardon Libby: Fitzgerald‚Äôs deplorable behavior in the days leading up to the sentencing. In pre-sentencing legal arguments, it became clear that Fitzgerald wanted the judge to sentence Libby, who had been found guilty of process crimes, as if he had instead been convicted of those more serious underlying allegations that formed the basis of the CIA-leak investigation. Fitzgerald ignored the fact that he had never brought charges under the Intelligence Identities Protection Act or the Espionage Act, and wrote that the grand jury ‚Äúobtained substantial evidence indicating that one or both of the statutes may have been violated.‚Äù He asked Judge Reggie Walton to treat Libby as if it had been proven that such crimes occurred.”

As I said before, this was where Fitzgerald actually tipped his hand to show his true agenda. It was clean - ‘covert’ and sinister.

Bill Kristol:

“Unlike the rest of us, however, George W. Bush is president. Article II, Section Two of the Constitution gives him the pardon power. George W. Bush can do something to begin to make up for the injustice a prosecutor appointed by his own administration brought down on Scooter Libby. And he can do something to avert the further injustice of a prison term.”

Although Kristol doesn’t think Bush will pardon him, the fact remains is he almost has to. With the immigration bill literally blowing up in his face and quite frankly blowing the Republican party up with it, this might just be the pill that cures many ills. Instead of effectually pardoning millions of illegal aliens, perhaps he should start pardoning with someone who was his closest advisor and friend.

After all it was Bush who essentially caved to Schumer’s demands and ok’d the investigation. In hindsight that was a mistake, not because Scooter got in trouble, but because as we all know there was nothing to see or find out in the first place. As facts become clearer - especially with Plame’s history twisting - that the wrong party got investigated.

Let me be clear. I don’t and no one should consider lying to authorities something to wink at. But the facts of the case - specifically that no underlying crime was committed - warrant a pardon or commutation of sentence. Significant also is the entirely unethical and partisen way that Comey hack Patrick Fitzgerald went about the prosecution. Entirely significant that ever Rudy Guilliani called him “out of control” during last night’s debate. That’s big considering Rudy being a former prosecutor - trying over 5000 cases as well as being Fitzgerald’s boss at one time.

Either way Libby shouldn’t see a day of jail.
