****Opps! Possible juror misconduct? ********Stay tuned*************
On well, so I can be wrong!*****UPDATE VERDICT AT NOON VIA DRUDGE******
UPDATE II: Libby found guilty on four of five counts - heading for appeal.
Breakdown:
Count 1 (Obstruction): GUILTY
Count 2 (Perjury): GUILTY
Count 3 (False Statement): NOT GUILTY
Count 4 (Perjury): GUILTY
Count 5 (Perjury): GUILTY
UPDATE: Motion for new trial (not much of a chance) to be filed, much more chance of an appeal being successful. Nevertheless, a Presidential pardon when Bush leaves office. Either way Libby won’t see a day in jail.
See more at hotair, michelle malkin and of course memeorandum.
UPDATE II: One note on the coming appeal, the defense will be allowed again to subpoena Russert, Cooper and others for further questioning, not at all good news for Russert who barely made it through the first round.
UPDATE III: One juror with a “possible” bias? On the drudge front page, “JUROR: WE HAD SYMPATHY FOR LIBBY, HE WAS THE FALL-GUY, WHERE WAS ROVE, WHERE WERE THE OTHERS…? ”
More from a juror: “Denis Collins (author of the book in the NRO link above), one of the jurors, addresses the press. He identifies himself as a former reporter. “The primary thing that convinced us on most of the accounts was the alleged conversation with Russert…It was either false (didn’t happen) or did happen…Mr. Libby was either told by or told to about Mrs. Wilson at least nine times…we believed he had a bad memory…but contradicted by testimony that he had an incredible grasp of details…even if he forgot who told him, it seemed very unlikely that he would have not remembered about Mrs. Wilson…tremendous amount of sympathy for Mr. Libby on the jury…jury asked “Where’s Rove? Where’s the other guys?” It seemed like he was the fall guy.” (h/t Malkin).
Heh….a “DC” Jury, what a surprise!
UPDATE IV: However, on the “Mrs Wilson” point Collins made, this may be the avenue of appeal if jurors in anyway considered Valerie Plame’s ’status’ as it would have violated Judge Walton’s order. I say the defense moves to secure all juror notes immediately as well as include them in future depositions.
UPDATE V: Pffffft! Madam of the House Pelosi can talk to me when she removes William Dollar Bill Jefferson from the Homeland Security Panel, outside of that she can shut her botoxed pie hole.
UPDATE VI: Here, here for the editors at NRO. A very distinct possibility as well.
UPDATE VIII: Howard Fineman making conclusions out of vanilla pudding.
UPDATE VIV: More on Denis Collins. In addition to authoring a “Spy Book”, he also authored a book on (drumroll) ENRON, and a fictional account of life in Washington.
**************************The below post occured just two hours before the verdict was announced, when it appeared to me an others that asking “what are we here for?” seemed a good signal. We’ll have to get the jurors take when (and if) they speak about their deliberations (see above).***********************************************
This is a confused and hung jury:
“WASHINGTON (AP) - Juror notes in the CIA leak case suggest some jury room confusion about what exactly former White House aide I. Lewis “Scooter” Libby is accused of doing.
After completing their ninth day of deliberations without a verdict Monday, jurors passed U.S. District Judge Reggie B. Walton three questions. All related to what Libby told the FBI regarding his 2003 telephone conversation with Time magazine’s Matt Cooper about CIA operative Valerie Plame.
Libby is accused of lying about what he told Cooper. Cooper says Libby confirmed that Plame worked at the CIA. Libby told FBI agents that he only told Cooper he’d heard about Plame from other reporters but didn’t know for sure whether she worked at the CIA.
In their questions, which were released Tuesday morning, jurors seemed confused about what Special Prosecutor Patrick Fitzgerald was alleging.
Were prosecutors saying Libby knew that Plame worked for the CIA by the time of his FBI interview, jurors asked, or does the government believe Libby’s account of the Cooper conversation was untrue?
There was no way to tell from the court discussion or the notes how far along the jury has come in weighing its verdicts on the five felony counts against the former chief of staff to Vice President Dick Cheney.
Walton said he would address the questions Tuesday.
This jury has asked four questions about the Cooper conversation. The questions offered a glimpse into the jury’s deliberations but it’s unclear whether they originated with only one juror or the group.
Defense attorneys could read them as a hopeful sign if they suggest the entire jury is confused, but prosecutors might see them as an opportunity to clarify something for a lone holdout juror.”
After ten days of deliberations and you have jurors asking, “What are we here for?”
What a travesty and a waste of taxpayer money this farse has been. Once thing is for sure, after this is all over perhaps its time for the Office of Special Responsibility to give request another look.

1And the storm clouds gather.
It’s high time to realize that our current sytem of “justice” is broken, fubared, TOAST!! In my humble opinion, the President should have fired a ton more prosecutors a LONG time ago, STARTING with FITZ!! What a load of crap!! Need I remind anyone that while Libby contemplates 20 or 30 years in prison…Sandy Berger, William Jefferson, Joe Wilson and his CIA wife, the entire editorial/news staff of the NYTimes, the Washington Post, the LA Times, and Chicago Tribune and on and on ad nauseum are laughing at this and still walking around scot free. WHY???
Jesus and there’s some idiot on Rush right now saying that Libby’s “Karma” is to blame. Jesus!! I sh*t you not!!

2Mac:
You know, I will be saddened with the departure of the President in January 2009 but I am sure he will be ready to retire to his ranch.
To watch the collaboration between the dems and the MSM to take down anyone associated with this good man is truly sickening.
This conviction of Mr. Libby today is just another example of a rouge press and BDS. Who would want to work in Washington as a Republican anymore?? This is truly a sad day for justice in our country IMHO.
